According to the Obama-era EPA, the proposed WOTUS definition would include all territorial seas, interstate waters and wetlands and all waters that are now being used - or which were used in the past or which may be susceptible for use in interstate or foreign commerce - including all waters subject to the ebb and flow of the tide.

Today, Governor Pete Ricketts and Nebraska agriculture and business groups applauded an announcement by Environmental Protection Agency (EPA) Administrator Scott Pruitt that the Trump Administration had finalized the repeal of the 2015 Waters of the U.S. (WOTUS) rule.

The EPA will publish the proposal in the Federal Register within days, at which point the agency will start accepting comments from the public.

In February, Trump signed an executive order directing the EPA and the Army Corps of Engineers to review Obama's expanded definition of navigable waters with a view to rescinding it.

One impact of killing this rule is that it throws the regulatory landscape of United States waterways back into pre-2015 chaos.

The rule sought to define the phrase "waters of the U.S." under the Clean Water Act, which had become the subject of legal disputes regarding water pollution cases, including two cases that reached the U.S. Supreme Court. The groups said in written statements that EPA's decision threatens wildlife and businesses that rely on clean water for hunting and fishing. "The livelihoods of American farmers, ranchers, and entrepreneurs were at stake". "This rule was a land grab that put property rights of Wyomingites at risk and would have done nothing to benefit water".

Borden called on the EPA to reconsider the repeal. But Pruitt offered few details about what this new rule could look like in today's announcement.

"We are taking significant action to return power to the states and provide regulatory certainty to our nation's farmers and businesses", EPA Administrator Scott Pruitt said. When it is completed, the agencies said, they will undergo a broader review of which waters should fall under federal jurisdiction.
