Supreme Court takes on new clash of gay rights, religion

On Monday, the court agreed to hear an October appeal by the owner of a Colorado cake shop who refused to bake a wedding cake for a gay couple in 2012.

Shannon Minter, legal director for the National Center for Lesbian Rights, which had petitioned the US high court along with attorneys for the couples, said similar issues are being litigated in other states but Arkansas was the only court to rule this way.

The petition stated that Phillips faced a stark choice: "Either use your talents to create expression that conflicts with your religious beliefs about marriage, or suffer punishment under Colorado's public accommodation law".

Xavier Becerra, California'a attorney general, urged the Supreme Court not to take the case.

Either way, a ruling is certain to have massive legal and cultural implications, and it may prove to be a landmark ruling similar to that of Roe v. Wade, with the ramifications being felt long into the future.

Phillips objected to this characterization and responded that he would happily sell the couple his baked goods for any number of occasions, but creating a wedding cake would force him to express something that he does not believe, thereby violating his freedom to run his business in accordance with his faith.

The couple filed a complaint with the state's Civil Rights Division.

Charlie Craig said in a statement that he and his husband were "disappointed that the courts continue debating the simple question of whether of whether LGBT people deserve to be treated like everyone else" and hoped that their "case helps ensure that no one has to experience being turned away simply because of who they are". The couple had married in MA but wanted a reception in Colorado, which did not allow gay marriage at the time. Jack Phillips, a born-again Christian and owner of Masterpiece Cakeshop in Lakewood, Colorado, cites religious beliefs as the reason he shouldn't be obligated to create the cake.

As our Policy Report noted past year, Cato is the only organization in the country that has gone to court to defend both one's right to marry a person of the same sex and one's right as a businessperson to join or not join as one chooses in assisting in celebrating a same-sex wedding.

So if a state helps to pay for new playground equipment, that subsidy can not be denied to a religious school on the shaky ground of "separation of church and state".

The suburban Denver baker argues that he did not turn away the gay couple in 2012 because they were gay, but because their marriage violated his religious belief.

In Mississippi, HB 1523 allows magistrates and judges to opt out of performing same-sex marriages, and allows businesses to deny wedding-related services to those couples. U.S. District Court Judge Tanya Walton Pratt ruled the law as unconstitutional previous year.

The U.S. Supreme Court, on an 8-1 vote, denied a motion to hear the case.

After all, the court is pretty well decided on this case, except for Kennedy. Other businesses have refused service to people living with HIV because of a belief that they are sinful.
