The court was hearing a batch of Public Interest Litigations (PILs) challenging the ban on women's entry into the sanctum sanctorum of the famed Sabarimala temple.

A bench of Chief Justice Dipak Misra, Justice R. Banumathi and Justice Ashok Bhushan also framed six questions to be addressed by the Constitution Bench.

The SC has referred the matter relating to bar on entry of women of 15-50 age group (menstruating age) in Sabarimala temple to a five-judge Constitution Bench on Friday.

On the other hand, the Constitution Bench will also decide whether the ban is protected by Article 25 (the right to religious freedom) of the Ayyappa devotees. This is the main reason for the dispute as women activists have questioned this as a clear practice of gender discrimination. This violates the rights of the women.

With this verdict by Supreme Court, the long sustaining protest against the entry of women tends to put an end to the practice.

It had also ordered to start the process of declaring Sharif's sons proclaimed offender for failing to appear before the court. After appearing before the court Maryam had said that she was not afraid of getting arrested.

The petitioners also includes the Travancore Devasom Board that manages the temple and women's organisations, The Indian Express reported.

Despite this, Sabarimala remains different from many traditional temples as it never observed caste distinctions, even as most temples in Kerala restricted entry to those belonging to the four varnas of Vedic Hinduism.

The Constiution Bench will answer the question whether a 1991 judgment of the Kerala High Court upholding the ban would amount to res judicata. "Every right needs to be balanced but every balancing has its own limitations", the report further added.
