Feds Allow States to Impose Work Requirements on Medicaid Beneficiaries

Health insurance reforms initiated during Barack Obama's presidency raised the income cap for access to Medicaid, allowing millions of low-income earners to join the Medicaid rolls.

IL is reviewing new guidance from the Trump administration that opens the door for states to impose work requirements on Medicaid recipients, but there is no indication yet that it will follow the lead of neighboring states that are pursuing plans to tighten their rules.

Kentucky Medicaid Commissioner Stephen Miller said Thursday the decision by federal authorities is key to winning final approval for the Bevin's proposal known as Helping to Engage and Achieve Long Term Health, or Kentucky HEALTH.

In his State of the State address Tuesday, Gov. Phil Bryant of MS, a Republican, said he supported a "workforce requirement" for able-bodied adults on Medicaid. Medicaid is pretty different from even other government health care programs; its beneficiaries are the poorest people in America, kids, and people with disabilities-a coalition of Americans who often have the most hard health care needs in the country compared with the employer-sponsored private health market. They also hearken back to the program's original intent, he added, "as temporary assistance to try to help people get back on their feet, not a permanent subsidy for someone's lifestyle, if they're capable of working". Medicaid plays a key role in the national response to the opioid epidemic, which the Trump administration has declared a public health emergency, for example.

Opponents of the move quickly decried the Trump administration's action, arguing that it represented a gutting of Medicaid and the administration's disregard for the poor (which was a big part of the pushback against the failed effort to replace Obamacare). Numerous specialists expect Kentucky will be the primary state endorsed.

Joan Alker, the executive director of Georgetown University's Center for Children and Families, tells Mother Jones that it's clear from the way the announcement was crafted that CMS is preparing for a legal challenge. So the legislature hired an independent vendor to do the job for them. This happened in OH in 2014, causing many people to lose Temporary Assistance for Needy Families (TANF) and SNAP benefits because of paperwork issues. Most who are not report reasons such as illness, caring for a family member or attending college.

Callow says the new policy will especially affect those who fall into a gray area of disability - those who don't get Medicaid disability benefits, but are still too sick to work.

The debate about work requirements doesn't break neatly along liberal-conservative lines. A comprehensive study of 11 mandatory work programs found that only two decreased poverty. Welfare data suggests that could lead to many people losing Medicaid. Work requirements played a major role in driving that decline.

Under the new CMS guidelines, states will be required to put "reasonable modifications" in place for those who need them, such as people with disabilities.

With each person contributing three hours of service, it totaled to 294 hours of volunteering for multiple causes. He said he would like to see improvements in community policing, economic development and education.

CMS did not directly address Medicaid expansion, which has been adopted by 31 states and the District of Columbia. In addition to traditional work and job training, engagement could include caring for a child or elderly parent, seeking treatment for drug addiction or going to school.

"Liberals find Medicaid work requirements repugnant because they believe that Medicaid beneficiaries want to work if they can, and that providing health coverage to people who cannot afford it is an obligation of any moral nation", Altman wrote. Those who don't could lose their insurance for six months at a time. Thats because children — who make up almost half of Medicaid enrollees — are excluded. The guidance explicitly states that budget neutrality still applies to 1115 waivers. "AHCCS isn't created to track people's work status and it's going to cost a lot of money to overhaul the system to ramp up this work requirement".

"Those who qualify for an exemption also must successfully document and verify their exempt status, which could be as often as monthly", she said in an emailed statement.
